Terms & Conditions
1. Privacy Statement
We are committed to protecting your privacy. Only authorized employees may access information collected from visitors, and only on a need-to-know basis. We continuously review our systems and data handling to maintain the best possible service for our customers. We may disclose personal information where legally required to do so.
2. Design Confidentiality & Non-Disclosure
We respect that your designs are your intellectual property. As a matter of policy, we do not disclose client designs, specifications, or branding to third parties without consent.
From time to time, and with client permission, select past work may be featured in our online portfolio. Any client may request removal of their work from the portfolio at any time, no questions asked.
Clients who have placed cumulative orders worth $6,000 USD or more (across a minimum of three separate orders, each at least $2,000 USD) qualify as Premium Clients and receive enhanced confidentiality protections, including default exclusion from the public portfolio unless they opt in.
3. Intellectual Property
4. Marketing & Promotion
5. Confidentiality
Client records are confidential and will not be disclosed to third parties other than our agents and manufacturing/supply partners involved in fulfilling the order, except where legally required. Clients may request copies of their own records on reasonable notice. Browsing data collected via our website is used only for internal review and is not shared externally.
6. Shipping & Delivery
DHL, FedEx, UPS and SkyNet are our primary couriers; we may use alternative carriers where appropriate for the delivery destination.
Typical transit times: DHL/FedEx Priority, 4–5 business days; DHL Parcel Post, approximately 2 weeks within the US/Canada and 2–3 weeks to Hawaii and Alaska. These are estimates, not guarantees.
The Sigma Apparel does not own its own freight carriers; shipments are arranged as a service to clients, and delivery guarantees, tracking accuracy, and loss/damage liability rest with the shipping company, not with The Sigma Apparel. If a shipment is lost in transit, the client is responsible for replacement production costs unless the carrier issues a waiver covering those costs.
7. Order Cancellation
Orders may be cancelled within 2 days of payment confirmation. Because all garments are custom-manufactured to client specification, cancellation is not possible after this window, regardless of the order’s production stage, and is never possible once goods have shipped or are in transit.
If a client fails to respond to a sample approval request within 30 days, the order will be automatically cancelled. In this case, the client may still recover the order amount as account credit, less any costs already incurred for setup and production to that point.
8. Delivery Responsibility
Clients are responsible for ensuring all delivery details — including address and recipient availability — are accurate and complete. The Sigma Apparel is not liable for failed or delayed delivery resulting from incorrect address information, recipient unavailability, or courier access issues. Once goods are dispatched to a reputable carrier, The Sigma Apparel’s delivery responsibility ends; further liability rests with the carrier.
9. Refunds
The Sigma Apparel manufactures to the specifications and quality standard confirmed by the client at the time of order. Any changes during production are communicated and confirmed with the client before proceeding. Because goods are custom-made, we do not accept returns or refunds once an order has been placed or shipped. Clients are encouraged to request progress photos or video check-ins to confirm garments match approved specifications before shipment.
Changes to an order are possible prior to bulk production approval, and after shipment with client agreement, though re-production and re-shipment costs in the latter case are borne by the client.
9.1 FULL REFUND
A full refund will be provided if a client wishes to cancel their order within 24–48 hours of payment confirmation. We understand that circumstances can change quickly, and we are happy to accommodate cancellations within this window. Please note that once this period has passed, no claim for a full refund will be entertained, as your payment is applied immediately toward production costs — including fabric procurement, pattern development, and factory scheduling. No refund will be issued once goods have been produced, shipped, or are in transit.
9. 2 PARTIAL REFUND
A partial refund is available if a client has received and reviewed their product sample and decides not to proceed with the bulk order, for any reason. We respect that the sample stage is an important decision point, and we will process the refund within one working week of your confirmed decision not to continue. Please note that the costs incurred for sample manufacturing — including fabric, production, and sample shipping — will be deducted from the final settlement amount. Refunds based on a change of mind after bulk production has commenced are not applicable.
9.3 DISCLAIMER
Should a client identify any imperfections or defects in their delivered order that were not present in the approved sample, The Sigma Apparel will thoroughly evaluate the reported issue and, where the defect is confirmed, arrange a replacement. We stand behind the quality of our work and will act swiftly to make things right. Please note that courier and shipping charges for any replacement order are the responsibility of the client.
10. Fabric Specification
We offer full fabric customization for qualifying order volumes. For smaller quantities, we source the closest available match in color and specification from ready-made market fabric, subject to availability at the time of order.
Custom-blended fabrics can only be guaranteed accurate when knitted to spec, which requires a minimum order of 1,000 pieces; these orders include a lab test report confirming the exact fabric composition.
11. Production Timeline
Production timelines begin once the client approves the order summary, issued within 24 hours of payment. Clients should review the order summary carefully, as changes cannot be made once it has been forwarded to production.
Timelines depend significantly on the speed of client communication and approvals — production pauses while awaiting client sign-off, which extends overall turnaround. Our standard estimate of 17 business days is a rough guide, not a guarantee; actual timing may vary due to fabric availability and other production factors. We will proactively communicate any delays.
12. Shipment Approval & Storage
Completed goods are stored free of charge for 15 days following production completion. After 15 days, a storage fee of $50 USD per day applies. If a client does not respond within 30 days, The Sigma Apparel reserves the right to ship the goods without further approval, at which point responsibility for any product issues transfers to the client. Orders left unaddressed for two months will be automatically cancelled without refund.
13. Force Majeure
The Sigma Apparel is not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, labor disputes, supply chain disruptions, or government action.
14. Governing Law
These Terms & Conditions are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any disputes arising from these terms shall be resolved in the state or federal courts located in Florida.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
16. Amendments
The Sigma Apparel may update these Terms & Conditions periodically. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
